1. Agreement to Terms

By accessing and using UnlockMoment ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our Service.

2. Description of Service

UnlockMoment is a privacy-first, client-side web application that allows users to create interactive digital gift cards with encrypted codes. The Service includes:

• Free scratch-to-reveal gift card templates
• Premium templates available for purchase
• Time-locked gift capsule functionality
• AES-256 encryption for gift codes
• PDF attachment support

3. How It Works

UnlockMoment operates entirely in your web browser (client-side). When you create a gift:

• Your gift code is encrypted using AES-256 in your browser
• An HTML file is generated containing the encrypted gift
• You download this file to your device
• You share the file with the recipient via your preferred method
• The recipient opens the file in their browser to unlock the gift

Important: UnlockMoment never transmits, stores, or has access to your gift codes or recipient information.

4. User Responsibilities

You agree to:

• Use the Service legally and ethically
• Not use the Service to transmit illegal, harmful, or fraudulent content
• Not attempt to reverse engineer, decompile, or hack the Service
• Not use the Service to distribute malware, viruses, or malicious code
• Ensure you have the right to encrypt and distribute the gift codes you use
• Not use the Service to harass, threaten, or harm others
• Comply with all applicable laws and regulations

5. Premium Features & Payments

Free Plan

• Access to 3 basic templates
• Includes UnlockMoment branding
• Full encryption and functionality

Premium Plans

• Single Premium Template: $2.99 per template
• All Access: $49.99 for unlimited templates and no branding

Payment Terms

• All payments are processed securely through Stripe
• Payments are one-time, not subscriptions
• Serial keys are delivered instantly after purchase
• All sales are final (see Refund Policy below)

6. Refund Policy

Due to the instant digital nature of our product:

• All sales are final
• Refunds are provided only in cases of technical failure or if the product cannot be delivered
• You may try our free templates before purchasing premium options
• If you experience technical issues, contact support before requesting a refund

7. License & Usage Rights

When you use UnlockMoment, you receive a non-exclusive, non-transferable license to:

• Create unlimited gift cards using available templates
• Share the generated HTML files with unlimited recipients
• Use the Service for personal or commercial purposes

You may NOT:

• Resell or redistribute UnlockMoment templates or source code
• Create competing services using our designs or technology
• Remove copyright notices from the source code
• Share your premium license key with others

8. Intellectual Property

All templates, designs, code, logos, and content provided by UnlockMoment are protected by copyright, trademark, and other intellectual property laws. The Service and all related materials are owned by UnlockMoment or its licensors.

Your Content: You retain all rights to the gift codes, messages, and PDFs you encrypt. UnlockMoment claims no ownership of your content.

9. Disclaimer of Warranties

• We do not warrant that the Service will meet your specific requirements
• We do not guarantee the accuracy or completeness of any content
• We are not responsible for third-party gift card codes (e.g., Netflix, Amazon) you encrypt
• You are responsible for backing up your generated HTML files

10. Limitation of Liability

To the maximum extent permitted by law:

• UnlockMoment shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the Service (if any) in the past 12 months
• We are not responsible for loss of data, profits, or business opportunities
• We are not liable for damages resulting from your misuse of the Service

11. Third-Party Gift Codes

UnlockMoment is not affiliated with, endorsed by, or sponsored by any third-party gift card providers (Netflix, Amazon, Spotify, Steam, etc.). You are responsible for:

• Ensuring you have the right to use and distribute the gift codes you encrypt
• Complying with the terms and conditions of the gift code issuers
• Verifying that gift codes are valid before encrypting them

12. Privacy & Data Protection

UnlockMoment is designed to protect your privacy. Please review our Privacy Policy for details on how we handle data (spoiler: we collect zero personal data).

13. Termination

We reserve the right to:

• Suspend or terminate access to the Service for violations of these Terms
• Modify or discontinue the Service at any time
• Revoke licenses for misuse or abuse

Termination does not affect your right to continue using HTML files you've already generated.

14. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.

Place of jurisdiction shall be the competent court in Horn, Austria. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Horn, Austria.

16. Dispute Resolution

In the event of any dispute arising from these Terms or the Service, you agree to first contact us at roland.kaloczi@outlook.com to attempt informal resolution.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
